Terms and Conditions 

for watersports activities offered by Pembrokeshire Wake Park Ltd of Cott Lane, Martletwy, Pembrokeshire SA67 8AB referred to below as ‘the company’.

Definitions: 

Pembrokeshire Wake Park (“the company”)

Customers: Any person (or parent/guardian if under 18) who is in attendance and/or participating in an activity organised by the company;

Guests: Anyone not participating in an activity but spectating, visiting our café, shop or premises; 

Activities: Including but not limited to Wakeboarding/ Ringo Rides/ Paddleboarding/ SUP Yoga/ Open Water Swimming/ Aqua Park

 

  1. BOOKINGS 

(including online bookings, phone bookings, and bookings made in person)

By submitting a booking the customer represents to us that they have the authority to make the booking for themselves, their child or on behalf of a group and that they accept that the booking is subject to these Terms and Conditions. A contract exists as soon as payment is received. Customers should check the details of their booking (which will be confirmed via email) carefully and promptly to ensure that it accurately reflects the arrangement they have requested. They should immediately inform us of any discrepancies.

 

  1. 1 PAYMENT:

All bookings must be paid for in full at the time of making the booking. This applies to all sales channels. No booking is confirmed until payment has been made and authorised. The company may allow for part payments or deposits to be made for large groups, but this is at the companies discretion.  

 

  1. 2 AUTHORITY:

By making a booking you confirm to us that you have the authority to make the booking on behalf of your party and that you accept on behalf of your party that the booking is subject to these Terms and Conditions. A contract exists as soon as payment for your booking is recieved.

 

  1. 3 PRICES:

All session prices are subject to change. However, once a customer has made a booking the price will not be subject to any change, with exception held for omitted details or invoice errors. To attend a session it must be paid for in full. If a session is booked for multiple people, the full price for all people is due before the activity commences. Any session not paid for will not be valid, the company reserves the right to cancel any booking without prior notice if full payment has not been made in accordance with these conditions.

 

  1. 4 ACTIVITY TIME: 

1.4.1 Cable Time

All bookings are made on the basis of the cable time shown in the description, i.e. Beginner Sessions provide at least 30 minutes of time on the water. Each session is 15 minutes long. Any increase in this time for any slot is at the discretion of the Manager and their decision is final.

 

1.4.2 Aqua Park Time

All bookings are made on the basis of the aqua park time shown in the description. Each aqua park pass, permits one participants to 45 minutes on the aqua park at their allocated time slot. Their allocated time slot will show a time of 1 hour, as this includes their safety briefing before entering the water and time to exit the water before the next session begins. 

 

1.4.3 Open Water Swim Time

All bookings are made on the basis of the open water swim time shown in the description. Each open water swim pass, permits one participants to 45 minutes swimming at their allocated time slot. Their allocated time slot will show a time of 1 hour, as this includes their safety briefing before entering the water and time to exit the water before the next session begins. 

 

 

1.5 DISCOUNTS:

1.5.1 Student discount

Student discount is made available at the point of booking. Students must select ‘Student Pay & Wake’ to receive their discount. Evidence of student status must be shown when you check-in. If no proof can be provided at the time of check-in and there is any doubt about the student status staff may request payment of the discounted value before allowing you to participate.

1.5.2 Large groups

Groups of 8 or more on the wake park will receive discount and 16 or more on the Aqua Park, however to receive this, you must book directly through reception rather than online. Discount will be confirmed in email with booking confirmation. 

 

1.6 RENTAL EQUIPMENT:

 

Rental wetsuits and obstacle wakeboards are available to reserve at the time of booking for a small price. The option to include a wetsuit and/or wakeboard will be shown at the end of the booking process before payment.

 

1.7 CONFIRMATION:

Once confirmed you should check the details of your booking carefully and promptly to ensure that it accurately reflects the booking you have requested. You should immediately inform us of any discrepancies or alterations.

 

1.8 CHANGES: 

Changes to times and dates for confirmed bookings can be carried out online, over the phone or via email, but must be completed a minimum of 48 hours before the booking is due. We will attempt to accommodate any change requests up to 48 hours before the booking, but it may not be possible due to other bookings.

 

1.9 INDIVIDUAL CANCELLATIONS: 

You may cancel your session at any time; however cancellation within 48 hours before your session start or non-attendance will result in the full loss of your session cost. No refunds will be given for cancellation more than 48 hours before your session, however the monies from your booking will be held as credit on your account within our system. We reserve the right, at our own discretion, to reattribute any lost session fees incurred through late cancellation or non-attendance.

 

1.10 GROUP CANCELLATIONS (8 OR MORE PEOPLE/ 2 HOURS OR LONGER):

Customers may cancel their session at any time, however, there are charges for cancellations made less than 7 days before a session commences. In the event of a cancellation less than 7 days before the session commences, the amount paid-to-date will be forfeited. Non-attendance will result in the cost for the session being forfeited. A refund is only available for cancellations made more than 7 days before a group session commences.

 

1.11 AGE RESTRICTIONS:

All bookings for activities that are age restricted require proof of age. If no proof of age can be provided at the time of check-in and there is any doubt about the age, it is at the discretion of staff to decide whether the customer can attend the session or not.

 

1.12 POSTPONENT:

Pembrokeshire Wake Park reserves the right to reschedule or cancel sessions at any time without prior notice, for example due to adverse weather conditions or any circumstance beyond our control. In the event of a cancellation/rescheduling, customers can choose to attend an alternative session or to have their session fee attributed to their account within the booking system.

 

2. CHECK IN

 

2.1 ARRIVAL:

You should arrive at least 30 minutes before the start time of your session to allow for check-in, changing, and any safety briefing (you should also allow 30 minutes after your session ends to return any hired equipment and shower/change).

 

2.2 LOCATION:

Pembrokeshire Wake Park is located on Cott Lane, Martletwy, Pembrokeshire, SA67 8AB. Check-in for the cable park is at the reception desk located in the clubhouse. Check-in for the aqua park is at ‘The hut’ (signs will guide you). Free parking is available on site, but spaces are limited, please try to car share wherever possible. 

 

2.3 WALK-UP BOOKINGS:

We can accept walk-up bookings if space exists. This cannot be guaranteed, and we strongly recommend pre-booking online. 

 

2.4 LATE FOR YOUR BOOKING:

Late arrivals will not be refunded. Cable Park Participants who for example have booked a 15 minute session and arrive 5 minutes late and take 5 minutes to get changed and in the water will only have 5 minutes remaining in the water. Aqua Park Participants will not be able to enter the water late, as they will have missed the safety briefing. 

 

2.5 CONSENT: 

All users of the cable park and aqua park or Pembrokeshire Wake Parks facilities for other activities will be required to sign a waiver form confirming they understand the restrictions, operating procedures, and rules. If customers are under 18, we will require their parent’s/guardian’s consent and signature on the waiver prior to them using the cable or aqua park, or participating in any other activity on Pembrokeshire Wake Park premises. No consent form will result in the customer not being able to attend their session – no refund will be given. 

 

Children under the age of 16 are not to be left without their parent/guardians supervision. Once consent has been given, participants aged below 16 years of age must be supervised by a parent/guardian on every visit, these parents/guardians must remain in the vicinity of the children at all times. 

 

All bookings for activities that are age restricted require proof of age. If no proof of age can be provided at the time of check-in and there is any doubt about the age, it is at the discretion of staff to decide whether the customer can attend the session or not.

 

2.6 RENTAL EQUIPMENT:

We have both wetsuits and wakeboards available for hire. These can be pre-booked, but can be paid for at check-in for a small additional charge.

 

2.7 CHANGING FACILITIES: 

We have dedicated changing areas for the wake park and aqua park. The male and female changing rooms for the wake park have access to two shower cubicles each. Access to showers is restricted to those using the wake park and is paid for under a voluntary scheme. The male and female changing rooms are in 2 containers located next to the aqua park. Lockers are also available, but Pembrokeshire Wake Park Ltd accepts no responsibility for possessions or belongings left in lockers.

 

3.0 GENERAL

 

3.1 HEALTH AND SAFETY:

The health and safety of all our visitors, customers and participants is of the highest priority at all times. Watersports Activities can be hazardous and customers (if under the age of 18 their parents/guardians) must accept that there are risks when practicing in the water sports/activities. Customers must comply with all safety and general instructions given by the company and it’s staff. When participating in a session, customers must be in general good health mentally and physically and must satisfy themselves that the activities are within their abilities. When completing the waiver, customers (if under the age of 18 their parents/guardians)  are declaring that they are in general good health mentally and physically and that the activities are within their abilities. The company reserves the right to refuse a booking on medical grounds. No participants are permitted to participate in any activity on Pembrokeshire Wake Parks grounds under the influence of alcohol or drugs. 

 

3.2 ACKNOWLEDGEMENT OF RISK:

 

THE PARTICIPANT IS AWARE AND UNDERSTANDS THAT WATER BASED ACTIVITIES, WATER SPORTS AND CABLE PULLED WATER SPORTS ARE INHERENTLY DANGEROUS AND ACCEPTS THAT HE OR SHE MAY BE EXPOSED TO RISKS AND DANGERS WHICH MAY OR MAY NOT BE FORESEEN OR KNOWN ABOUT BUT WHICH CAN CAUSE SERIOUS INJURY OR DEATH. 

 

Cable Park

The participant acknowledges that such risks include, but are not limited to, drowning, falling, colliding with the shore/ island/ vegetation/ lily pads or submerged or floating objects/ debris/ anchor ropes, presence of insects/ bacteria/ algae/ fish and amoebas in the water, becoming entangled in the rope or handle, extreme physical stress from being pulled across the water by the cable facilities at high speeds which may be at twice the cable speed, jumping high into the air, flipping, and riding over manmade and natural objects, jump ramps, sliders, buoys, and other obstacles, being struck by other riders or the handle, equipment injuries, breaking of wakeboards and wake skates, trip hazards located on the land, dock area and clubhouse and the potential for contracting illness or disease such as Weils disease, Ecoli etc. 

 

As a result of the understanding and appreciation of the great risks involved with these activities, the Participant agrees to assume and bear full responsibility and sole liability for any death, injury, illness or other losses or property damage (including parked vehicles) occurring on the premises or from the use of the cable park that are sustained by the Participant. The Participants also acknowledges the he or she is fully aware that severe social and economic loss may result from the action or inactions of the Participant while engaged in this activity and agrees to bear full responsibility.  

                         

Aqua Park

The participant acknowledges that such risks include, but are not limited to, drowning, falling, colliding with the shore, Lake side trees/ vegetation, lily pads or submerged or floating objects/ debris/ anchor ropes/ presence of insects/ bacteria/ algae/ fish and amoebas in the water, becoming entangled in the rope, extreme physical stress, jumping high into the air, flipping, and moving over manmade and natural objects, the aqua park features, buoys, and other obstacles, being struck by other participants or equipment injuries, trip hazards located on the land, aqua park area and premises and the potential for contracting illness or disease such as Weils disease, Ecoli etc. 

As a result of the understanding and appreciation of the great risks involved with these activities, the Participant agrees to assume and bear full responsibility and sole liability for any death, injury, illness or other losses or property damage (including parked vehicles) occurring on the premises or from the use of the cable facilities that are sustained by the Participant. The Participants also acknowledges the he or she is fully aware that severe social and economic loss may result from the action or inactions of the Participant while engaged in this activity and agrees to bear full responsibility.  

 

Open Water Swimming

The participant acknowledges that such risks include, but are not limited to, drowning, falling, colliding with the shore/ island/ vegetation/ lily pads or submerged or floating objects/ debris/ anchor ropes, presence of insects/ bacteria/ algae/ fish and amoebas in the water, becoming entangled in the rope or handle, being struck by other swimmers, equipment injuries, trip hazards located on the land, dock area and clubhouse and the potential for contracting illness or disease such as Weils disease, Ecoli etc. 

 

As a result of the understanding and appreciation of the great risks involved with these activities, the Participant agrees to assume and bear full responsibility and sole liability for any death, injury, illness or other losses or property damage (including parked vehicles) occurring on the premises or from the use of the lake that are sustained by the Participant. The Participants also acknowledges the he or she is fully aware that severe social and economic loss may result from the action or inactions of the Participant while engaged in this activity and agrees to bear full responsibility.  

3.3 SAFETY EQUIPMENT:

All wakeboarders are required to wear a buoyancy aid and helmet at all times, all ringo ride participants are required to wear a buoyancy aid at all time. Both helmets and buoyancy aids are supplied free of charge by the company. All users of the aqua park are required to wear a buoyancy aid at all times, which are supplied free of charge by the company. All swimmers are asked to ensure they are wearing suitable wetsuits for the water temperature, to wear their tow float and coloured head caps.

 

3.4 MEDICAL ATTENTION:

Medical conditions must be declared and signed in advance by all customers. The customer will permit for basic First Aid to be administered by a qualified member of staff or by a qualified medical practitioner and in case of a medical emergency for a medical practitioner to provide emergency treatment and/or medication.

 

3.5 UNRULY BEHAVIOUR:

Customers are required to be considerate towards others and the companies neighbours, keeping noise levels to a minimum and using Cott Lane in a safe manner. If the customer or any member of their party is behaving in such a way as to cause danger, upset or distress to any third party or damage to property, the company reserves the right either for the safety of staff or other participants to remove the person from the activity if necessary. No refunds will be given and the customers are liable for any damage caused. The consumption of alcohol or drugs/illegal substances on the company’s premises is strictly prohibited. Alcohol is only permitted at organized events, but is not to be consumed before or during participation of an activity. Parents/guardians are liable for their children.

 

3.6 DAMAGE:

Should damage or loss to persons or equipment be caused as a result of willful damage or gross negligence by a customer, a customer under the influence of alcohol or drugs or as a result of refusal or failure to obey instructions given by our staff, then he or she will be liable for the full amount of repair or replacement and any resulting costs. The cable operator and instructor/ lifeguard or any other supervisor reserves the right to terminate the session/event. Adults will at all times be responsible for minors in their charge. 

 

3.7 INSURANCE:

Whilst Pembrokeshire Wake Park Ltd holds Public, Product and Employee Liability Insurance policies, we cannot be held responsible for any loss, damage or death to any person or personal possessions. We recommend that you take out appropriate insurance cover yourselves for such uninsured losses.

 

3.8 INTELLECTUAL PROPERTY

The copyright and all other intellectual property rights in the products and services shown in the company’s brochures, website and other materials shall at all times remain the property of the company.

 

3.9 COMPLAINTS: 

Pembrokeshire Wake Parks Facilities Manager is available to deal with any issues arising from your activity. It is essential you raise any issues during your time at the wake park so they can be dealt with immediately. 3.10 PHOTOGRAPHS:

We occasionally take photographs during our sessions, which may appear in our brochures, website and other marketing materials. If a customer does not wish to be photographed this should be raised with Pembrokeshire Wake Park in writing before the session commences.

 

3.11 Data Protection:

Personal information requested by Pembrokeshire Wake Park is held in its original form. WakeSys is the data controller for the purposes of GDPR, 2018 and will process the data in accordance with the act. Pembrokeshire Wake Park will not divulge customer information to Third Parties. Please see our Privacy Policy for further information with regards to how your information is handled. 

 

3.12 WAIVER:

Pembrokeshire Wake Park Ltd reserves the right to waive any or all of the conditions.

 

3.13 Understanding of Terms and Conditions

The company’s acceptance of any booking will only be done subject to the customer’s acceptance of these conditions and the Terms and Conditions. Payment of the customer (parent/guardian if under 18) will be regarded as evidence of acceptance of and consent to these conditions. I give consent for me/my child/children to participate in the ‘activities’ as defined. I acknowledge and accept that the Activity is dangerous and that by participating in the Activity I and the child(ren) are exposed to the possibility of personal injury and/or death and/or property damage and I accept this risk on my behalf and on behalf of the child(ren).In the event of an accident involving myself and/or my child(ren), I acknowledge and accept that “the company” will not be liable for any direct or indirect loss, damage or injury arising from or in connection with my and/or the child(ren)’s participation in the “activities” and I hereby waive all and any claims against “the company” in this respect and in respect of myself and the child(ren).I hereby release, waive, forever hold harmless, indemnify and keep indemnified “the company” from all claims for any injury, loss or damage sustained by me and/or the child(ren) arising from or in connection with the “activities” no matter how arising andI hereby indemnify “the company” against all claims made by any other person against “the company” in respect of any injury, loss or damage arising out of or in connection with my failure and/ or the failure of the child(ren) to follow safety instructions and/or directions of “the company” their employees, volunteers, agents, sponsors and directors. 

I acknowledge and accept that this waiver may be pleaded as a bar to any action or proceedings taken by me and/ or my child(ren) at any time against “the company” arising out of or in connection with my and/or the child(ren)’s participation in the “activities”.

 

3.14 Health Declaration: 

I hereby declare that I or my child is fit to participate in the activities run by the company. Bookings are accepted by the company on the basis that all details provided by participants are correct. 

 

 

4. Pembrokeshire Wake Park Packages Terms and Conditions

 

4.1 Wakeboarding General 

  1. Riders must be 8 years of age or above; 

  2. Able to swim at least 25 meters competently unaided; 

  3. In general good health and be able to satisfy themselves that the activities are within their abilities; 

  4. Under 16's must be accompanied and supervised by a parent/ guardian at all times.

 

Equipment Includes: helmet, buoyancy aid and standard wakeboard.

If riders require wetsuits  or obstacle boards, these can be hired for an additional £3 each.

Anyone hitting obstcales must be obstale standard and able to perform the following:

-Hold a hard heelside and toeside edge

-Negotiate corners

-Ollie

-Turn the board from regular to switch and back

-Ride switch at least 100m

-Ollie to switch

 

If It is your first time to the wake park, you must arrive a minimum of 30 minutes before the startof your session. Ifyouhave been to the wake park before you must arrive a minimum of 15 minutes before the startof your session. 

 

4.2 Beginners Lesson

  • Beginners Lessons include all equipment, a dry land lesson and 2x15 minute sets on the water. 

  • Once this package has been purchased it is non-refundable. 

  • Sessions must be pre-booked to ensure availability.

 

4.3 Pay and Wake 

  • Pay and Wake sessions include 1x15 minute set on the water. 

  • Only buoyancy aids, helmets and standard boards are provided. 

  • Additional sets can be purchased for £15 but must be used on the same day as the original booking. 

  • Whilst beginners can choose this option, please note that you will require a dry land safety briefing and this will reduce the amount of time you will have on the water during your 15 minute session. PWP advise and encourage beginners to select the ‘Beginners Lesson’ package.  

  • Once this package has been purchased it is non-refundable. 

 

4.4 Progression Sessions 

  • Progression sessions include 6 x15 minute sets on the water.

  • All kit is included. 

  • The sessions will be credited to the participants account on payment. 

  • The packages can only be purchased once per person. 

  • You have one year from the date of purchase to use your 'Progression Session' credits.  

  • Once this package has been purchased it is non-refundable. 

 

4.5 Day Pass 

  • Day passes include 3x15 minute sets on the water. 

  • Only buoyancy aids, helmets and standard boards are provided. 

  • Sessions must be pre-booked before arrival to ensure availability.

  • Additional sets can be purchased for £15 but must be used on the same day as the original booking. 

  • Once this package has been purchased it is non-refundable. 

 

4.6 Memberships 

  • Hire of wetsuit and obstacle boards is not included in memberships.  

  • You are signed up to a pay monthly contract until November 30th 2019*.

  • You cannot under any circumstances cancel this contract.

  • Once you have ridden your allocated sessions, you may purchase extra sessions at £10 each. These are booked on site at reception or online with a voucher code.

  • Members can book Jam nights for £10.00 These are to be booked at reception.

  • If you cancel a booking with 24 hours notice or greater there is no charge.

  • If you cancel a set with less than 24 hours notice there is a £10 charge.

  • If you don’t turn up for a booked set there is a £15 charge. 

  • Pembrokeshire Wake Parks opening hours/days of the week may vary throughout the season.

  • All members are restricted to booking a maximum of 2 sets per day. 

  • Sessions paid for via membership are to be used by members only. 

 

4.6 Bulk Buys

  • You have one year from the date of purchase to use your 'Bulk Buy' credits

  • Bulk buys are only to be used by one person, they are not to be shared amongst friends/family

  • Only buoyancy aids, helmets and standard boards are provided. 

  • Once this package has been purchased it is non-refundable. 

 

4.7 Jam Sessions

  • These sessions are not suitable for beginners. 

  • Riders must be up to obstacle standard to book onto Jam Sessions.

  • These sessions must be booked in advance. 

  • Only buoyancy aids, helmets and standard boards are provided. 

 

4.8 Family Packs

  • You have one year from the date of purchase to use your 'Family Pack' credits. 

  • Family pack sessions can be used by any direct family member (Mum, Dad & Kids).

  • Only buoyancy aids, helmets and standard boards are provided. 

  • Once this package has been purchased it is non-refundable. 

 

4.9 Ringo Rides 

Riders must be:

  1. 6 years of age or above; 

  2. at least one meters tall; 

  3. able to swim at least 25 metres competently unaided;

  4. in general good health and be able to satisfy themselves that the activities are within their abilities; 

  5. and accompanied and supervised by a parent/guardian if under 16 years of age.

 

  • Ringo Rides sessions include 1x15 minute ringo ride on the water;

  • Ringo rides can be shared between 2 adults or 3 children maximum;

  • Buoyancy aid and helmet are included.

  • Once this package has been purchased it is non-refundable. 

4.10 Aqua Park

 

If you are late for your session and miss your safety briefing you will not be allowed on the water. Please arrive a minimum of 30 minutes before the start of your session. 

 

Participants must be:

  1. 6 years of age or above;

  2. at least 1.1 meters tall;

  3. able to swim at least 25 metres competantly unaided;

  4. in general good health and be able to satisfy themselves that the activities are within their abilities;

  5. and if under the age of 14 accompanied and supervised on the water by an adult (18 years or older). Maximum ratio of children supervised by one adult is1 adult:3 children.

  6. If 14-16 years of age, they do not have to be accompanied on the water, but must be supervised from land by an adult (18 years or older). No ratio for 14-16 year old supervision. 

 

  • Aqua Park sessions last 1 hour. With 45 minutes of time on the water and 15 minutes for your safety briefing, entry and exit of water. 

  • Buoyancy aids are included.

  • Sessions must be pre-booked to ensure availability. 

 

4.11 Open Water Swimming

 

If you are late for your session and miss your safety briefing you will not be allowed on the water. Please arrive a minimum of 30 minutes before the start of your session. 

 

Participants must be:

 

  1. Minimum age of 8;

  2. Children under the age of 14 must be accompanied by a parent/guardian in the water at alltime;

  3. at least 1.1 meters tall;

  4. able to swim at least 200 metres competantly unaided;

  5. in general good health and be able to satisfy themselves that the activities are within their abilities;

  6. Wearing the correct wetsuit/swimsuit for the water temperature;

  7. Wearing the correct colour head cap for age/ability;

  8. Wearing a tow buoy. 

 

  • Aqua Park sessions last 1 hour. With 45 minutes of time on the water and 15 minutes for your safety briefing, entry and exit of water. 

  • Sessions must be pre-booked to ensure availability.
